the Court shall communicate the application to the original claimant, if known, and to
the victim or his next of kin, if appropriate.

Consequently, it is not admissible to argue, as the State has done, that the
Commissions’ transmittal of the application to the petitioner contravenes any
provisions of the procedure before the Court or the Commission.

In view of the foregoing, the Court rejects the third preliminary objection
because it is without merit.
