The facts of the case concern the lack of reparation and compensation for the relatives of those murdered or disappeared between 1973 and 1974 during the military dictatorship in Chile because judicial tribunals applied the rule of statutory of limitations and rejected the claims.

In its sentence, the IA Court analyses the facts from the perspective of the right to access to justice with regards to the civil actions of reparation of damages resulting from facts qualified as crimes against humanity.
