Case- Summary
The facts of the case concern the extrajudicial execution of Pedro Huilca Tecse, a Peruvian union leader, which took place on December 18th 1992 and was carried out by members of the “Colina” group, a squad linked to the Intelligence Service of the Peruvian Army.
The IA Court developed standards on the people’s right of free association without public authorities intervening to curb it or obstruct its exercise. Additionally, it examined the execution of a union leader not only as the restriction of an individual’s freedom of association but also as an attack to the right and freedom of a certain group to freely associate without fear to do so. It concluded that the facts of the case had an intimidatory effect on the workers of the Peruvian union movement, diminishing the group’s freedom to exercise that right.
