domestic measures to make reparations to approximately 28,000 workers dismissed
irregularly from 1990 to 2000. The State points out that several of the petitioners in
this case have accepted said benefits and that the others could accede to
them. Therefore, the State alleges that its domestic legislation includes a mechanism
appropriate for resolving the complaint made in the petition.

Without prejudice to the merits of the complaint, the IACHR
concludes in this report that the case is admissible with regard to the alleged violations
of the right to a fair trial (Article 8), freedom from ex post facto laws (Article 9), and
the right to judicial protection (Article 25), recognized in the American Convention, as
per the general obligation to respect and guarantee rights enshrined in Article 1.1 and
the duty to adopt measures enshrined in Article 2 of said instrument, given that the
complaint meets the requirements set forth in Article 46 of the American Convention

Therefore, the Inter-American Commission
undertakes to notify the parties of the decision and to continue to analyze the merits of
the alleged violations of the rights to a fair trial and to judicial protection, recognized in
the American Convention, in accordance with the general obligation to respect and
guarantee rights enshrined in Article 1 and the duty to adopt measures enshrined in
Article 2 of said instrument.
II.
PROCESSING BEFORE THE COMMISSION
5.
The Commission received the complaint lodged by the Consolidated
Petroleum Workers Union of Peru on February 19, 1996. The IACHR sent the petition
to the State via a communication dated April 1, 1996. On July 26, 1996, the State
submitted a note requesting further information about the petitioners’ claim. On
