To dismiss the preliminary objection filed by the State regarding the failure to exhaust domestic remedies under the terms of paragraph 29 of this Judgment. DECIDES, Unanimously that: 2. The State is responsible for the violation of Article 8(1) in conjunction with Article 1(1) of the American Convention, to the detriment of the 27 victims in this case, because they were dismissed from office by an incompetent body that did not grant them an opportunity to be heard, under the terms of paragraphs 156 to 169 and 180 of this Judgment. 3. The State is responsible for the violation of Article 8(1) in conjunction with Article 23(1) (c) and Article 1(1) of the American Convention, to the detriment of the 27 victims in this case, given the arbitrary effects on their tenure in office and the consequent effects on judicial independence, under the terms of paragraphs 143 to 180 of this Judgment. 4. The State is responsible for the violation of Article 25(1) in conjunction with Article 1(1) of the American Convention, inasmuch as the victims were denied access to an effective legal remedy, under the terms of paragraphs 185 to 194 of this Judgment. 5. The State is not responsible for the violation of Article 24 in conjunction with Article 1(1) of the American Convention, under the terms of paragraphs 195 to 198 of this Judgment. 6. The State is not responsible for the violation of Article 2 of the American Convention, under the terms of paragraph 184 of this Judgment. 7. It is not appropriate to issue a ruling regarding the alleged violations of Articles 8(2) and 9 of the American Convention on Human Rights, under the terms of paragraph 181 of this Judgment. 80
