Provincial Prosecutor; Marcos Leonidas Sierra Tuero, who was detained at the Lircay police station on March 20 1999; Mrs. Maura Romero, the owner of “Los Manolos” Hotel; Juan Martín Silva González; the Municipal Director of Lircay; and, several police staff members. 55 Among the conclusions issued in his reports of March 1999, the People’s Defender stated: - it is noted that the disappeared person was detained arbitrarily, without any complaint or report, since PNP sub-officer Cuaresma Ramos, at the time of the intervention, should have requested that Patrick Flores Gutiérrez and Luis Guerrero Pareja accompany him to present the corresponding charges; further he proceeded to detain him based merely on the statements of the first of the persons named […]. In any event, the detention of Walter Munárriz Escobar should have been recorded in the appropriate books. 56 - there is evidence of the disappearance of citizen Walter Munárriz Escobar at the hands of police personnel of the Provincial PNP Department of Lircay, due to the unusual activities they were engaged in on the day of the event, such as making visits to inspect the Julcaní and Ccochacasa camps; it is worth noting the extreme nervousness and tension of Captain Roberto Gaistiaburú Nakada at the time of the procedures that occurred at the Angaraes Provincial Police Department. 57 68. However, it´s report No. 020-099-RDP/HVCA of March 29, 1999 report, the People’s Defender wrote: […] Without prejudice to the foregoing, the possibility is not ruled out that Walter Munárriz Escobar, overwhelmed by his family problems and the aforesaid events went away to someplace else […]58 69. In his report dated April 22, 1999, taking into account all the gathered information, the Office of the People’s Defender concluded as follows: The investigations conducted have demonstrated that citizen Walter Munárriz Escobar was arbitrarily detained at the Lircay-Angaraes Peruvian National Police Station on 3/20/99; said detention was not registered in either the books for common street crimes or the record of detainees of that police station. During his detention, he was subjected to physical and verbal abuse by police personnel, with the following officers identified so far: PNP Lt. Claudio Gutiérrez Velásquez, and PNP SO2 officers Gunther Cuaresma Ramos and Adolfo Ángeles Ramos. It has not been proven that Walter Munárriz Escobar was released after being detained. 59 70. Furthermore, the Office of the People’s Defender stated in its October 3, 1999 report that “it is unquestionable that as a result of the negligent, biased conduct of the former Angaraes Provincial Prosecutor […], the defendants had access to prejurisdictional investigations, when they received the initial statements at the PNP Angaraes Provincial Headquarters, which is why, in providing their statements, they made a uniform 55 Annex 31 .
