The facts of the case concern the death of Laura Susana Albán Cornejo as a result of the medical assistance she received for bacterial meningitis following her admission to the private health facility the Hospital Metropolitano.

The IA Court analyzed the response of the criminal justice system in terms of the investigation and clarification of the events, and established standards with regards to access to medical files and the obligations of professional health oversight bodies. Additionally, the IA Court established that it corresponds to the State to decide on the inclusion of the specific crime of medical mala praxis in its domestic law, taking into account that this can be considered within the existing crimes of homicide or personal injury.
