The facts of the case concern the disciplinary procedures and subsequent separation of his post from the Supreme Electoral Tribunal judge, Eduardo Benjamín Colindres, in November 1996.

In its sentence, the IA Court analyzed whether the proceedings carried out were in accordance to the guarantees of due process and if, due to his arbitrary dismissal, his right to remain in public office in conditions of equality was violated.
