discarded important pieces of evidence and did not take the appropriate steps to secure the scene
of the crime. The petitioners are also claiming an unwarranted delay in the investigations, which
have gone on for more than what can be considered a reasonable period of time. They argue that
the State cannot claim the complexity of the matter under investigation, as the State has not
managed to demonstrate that investigations are actually open or underway. They also assert that
the procedural activity of the interested parties cannot be claimed, since on September 27, 2005,
the Supreme Court denied the petition of amparo that the Public Prosecutor’s Office filed on the
victims’ behalf.
