The facts that support a provisional measures request in favor of Mrs. de la Cruz Flores concern the protection of her personal freedom given the risk of being detained based on proceedings pending before Peruvian courts. The Inter-American Court of Human Rights did not issue the measures because it considered the issue to be related to the State under the judgment on merits, reparations and costs of November 18, 2004.

In November 2011, a request was filed again and the Inter-American Court once again rejected the request. The same happened with the filing in January 2016 for not meeting the formal requirements.
