The request for provisional measures is based on facts surrounding the harassment and impact upon the honor of the victims of the case of the Miguel Castro Castro Prison through the publication of articles in the media. The arrest warrant issued against Mónica Feria Tinta was included, but the Inter-American Court considered that this had not been a part of the facts discussed within the the Castro Castro Prison case.

The Inter-American Court rejected the request because it considered that it did not meet the minimum requirement of extreme gravity and urgency.

In December 2007, the victims reiterated their request for protection and the Court again rejected the request.

In December of 2017, the victims presented a new request for protection in the context of the pardon given to former President Alberto Fujimori. The Inter-American Court dismissed the request.
