91. On the basis of the analysis and conclusions of the present report, THE INTER-AMERICAN COMMISSION ON HUMAN RIGHTS RECOMMENDS THE FOLLOWING TO THE STATE OF NICARAGUA: 1. To provide comprehensive reparations for the violations of the rights stated in the present report, including the payment of compensation for the violation of the right to have equal access to the country’s public service. 2. To adopt the measures of non-repetition to guarantee the equality of all participants in the presidential electoral process. In particular: 1) to provide the necessary measures so that the regulatory framework for elections and its application shall guarantee the equality of all candidates in an electoral contest and prevent the incumbent administration from failing in its duty to be neutral in the process and from securing undue advantages by using public resources or the media, 2) to take the necessary measures to strengthen and guarantee the independence of the Supreme Electoral Council; and 3) to provide legislative, administrative, and any other kind of measures that might be needed to create an effective and simple remedy for challenging the resolutions of the Supreme Electoral Council, without limitations regarding the matter being appealed.
