Additionally, it violated the duty to adequately state the grounds for its decisions, in keeping with Article 8.1
of the American Convention.

CONCLUSIONS

Based on the foregoing considerations of fact and law, the Commission concludes that the
State of Peru is responsible for the violation of the rights to a fair trial and freedom of expression, in
accordance with Articles 8.1 and 13 of the American Convention in connection with Articles 1.1, 2 and 16.1
thereto, to the detriment of Alfredo Lagos del Campo.
VI.
RECOMMENDATIONS

Based on the above conclusions,
THE INTER-AMERICAN COMMISSION ON HUMAN RIGHTS RECOMMENDS THAT THE STATE OF PERU:
1.
Provide comprehensive reparation to Alfredo Lagos del Campo for the violations stated
herein. This reparation must include both the pecuniary and non-pecuniary aspects.
2.
Adopt measures of non-repetition to guarantee that workers’ representatives and labor
union leaders can enjoy their right to freedom of expression in accordance with the standards established in
this report.
3.
Adopt measures to ensure that the application and interpretation of laws by the domestic
courts are consistent with the principles established by international human rights law with respect to
freedom of expression in labor-related contexts, reiterated in this case.
