20 race, sex, religion, nationality or political opinion, or that the situation of the person whose extradition is sought may be prejudiced by any of these considerations in the course of the judicial proceedings; (c) the crime for which extradition is sought is a purely military crime under the laws of the requesting Contracting Party; (d) under the laws of the requesting Contracting Party, the person whose extradition is sought enjoys immunity from prosecution or from enforcement of sentence for any reason, including the statute of limitations, clemency or amnesty; (e) The requested Contracting Party has already issued a final judgment or has finalized proceedings against the person whose extradition is sought for the crime specified in the extradition request; or (f) under the laws of the requesting Contracting Party, the extradition request concerns a case that can only be instituted on the basis of a complaint filed by the victims. Article 4 Discretionary grounds for denying extradition Extradition may be denied if: (a) under its domestic laws, the requested Contracting Party has jurisdiction over the crime for which extradition is requested, and is in the process of conducting a case or intends to bring a case against the person being sought for that crime, or (b) the requested Contracting Party considers that extradition would be incompatible with humanitarian considerations such as the age and/or state of health of the person whose is sought and other personal considerations. Article 5 Condition precedent for extradition Extradition shall only be carried out if it is not contrary to the requested Contracting Party’s system of laws. Article 6 Channels of communication For purposes of the present Treaty, the Contracting Parties shall communicate with each other by way of their duly designated authorities, unless the present Treaty provides otherwise. Until those authorities are designated, the Contracting Parties shall communicate with each other through diplomatic channels. Article 7 Extradition request and required documentation 1. The extradition request shall be in writing and shall include the following:
