On October 7, 1997, the State offered the testimony of Mr. Julio Aníbal TrejoDuque. The State claimed that although this offer was time-barred, it was justified by the fact that the witness’s health, which had prevented him from appearing earlier before the Court, had improved. The State further claimed that Mr. Trejo’s testimony would help "determine accurately the reasons why the detention order issued had been revoked, why the judge had not imposed a prison sentence, and why the preliminary hearings were still open."
