V. CONCLUSIONS 48. The IACHR has established in this report that it has jurisdiction to examine the petition lodged regarding the alleged violation of the right to humane treatment, to a fair trial, and to judicial protection of Valdemir Quispialaya Vilcapoma. 49. The Commission concludes that the petition is admissible, in accordance with Article 47(a) of the American Convention. On the grounds of the aforementioned factual and legal arguments, THE INTER-AMERICAN COMMISSION OF HUMAN RIGHTS, DECIDES: 1. To declare the present petition admissible in relation to Articles 5, 8, 25, and 1(1) of the American Convention and to the Inter-American Convention to Prevent and Punish Torture. 2. To notify the petitioners and the State of this decision. 3. To publish this decision and include it in the Commission’s Annual Report to the OAS General Assembly.
