18 58. A referida resolução "condemns the practice of extraordinary renditions, which is aimed at ensuring that suspects are not brought before a court but are transferred to third countries to be interrogated, where they could be tortured, and detained in facilities controlled by the USA or local authorities"; além disso, a resolução "considers unacceptable the practices of certain governments consisting in limiting their responsibilities by asking for diplomatic assurances from countries in respect of which there is strong reason to believe they practice torture" (par. 10). e, a seguir, a mesma resolução "Stresses that the prohibition of torture or cruel, inhuman and degrading treatment as defined in Article 1 of the U.N. Convention against Torture, is absolute and allows no exceptions whether in times of war or threat of war, domestic political instability or any other emergency; recalls that cases of incommunicado detention, abduction or extraordinary rendition constitute violations of fundamental rights in International Law, in particular Articles 3 and 5 of the European Convention on Human Rights, especially since these acts are synonymous with torture or inhuman and degrading treatment" (par. 29).61 59. Condor redivivus! Seus métodos e práticas atrozes e desumanas continuam sendo seguidos e aplicados, em contexto distinto, em nossos dias! Quando aprenderá o ser humano com as lições do passado, com o terrível sofrimento das gerações anteriores? Se não aprendeu até hoje, talvez nunca aprenderá. Quando deixará o ser humano de desumanizar seus semelhantes? Se não deixou de fazê-lo até hoje, talvez nunca deixará de fazê-lo. E continuará convivendo com o mal, e submetendo-se a ele. É por isso que a luta pela primazia da recta ratio62 não possui fim, como no mito de Sísifo. 60. Em nada surpreende, pois, que o problema do mal tenha sido e siga sendo uma das grandes preocupações ao longo de toda a história do pensamento humano ao longo dos séculos, filósofos, teólogos e literatos se ocuparam do problema, sem encontrar uma resposta conclusiva ou inteiramente satisfatória. Como bem advertiu R.P. Sertillanges em uma obra magistral sobre a matéria, "L'angoisse du mal s'impose à toutes les âmes, à tous les groupes et à toutes civilisations. (...) Le problème du mal met en cause a destinée de chacun, l'avenir du genre humain".63 61. Definitivamente, não se combate o terror com o terror, mas dentro do Direito. Como me permiti advertir também em meu Voto Fundamentado no Caso dos Massacres de Ituango versus Colômbia (Sentença de 01.07.2006), lamentável e tragicamente os crimes de Estado continuam "repetindo-se em distintas latitudes, em meio à manipulação, ou fabricação da assim chamada "opinião pública" (ou publicada).
