Case- Summary
The case relates to the detention, prosecution and conviction by a court martial of 12 people, members of the Air Force of Chile, all collaborators of the government of President Allende. During his detention they suffered ill-treatment and torture for the purpose of extracting confessions.
The Inter-American Court analyzed aspects of the state obligation to investigate in situations of torture, as well as the right to access to information in truth commission files. In addition, the Inter-American Court referred to appeals in light of the right to judicial protection.
