The facts of the case concern violations of the principle of presumption of innocence and the court’s obligation to provide a reasoned judgment in the case of the conviction of Mr. Agustín Bladimiro Zegarra Marín who was Commander of the National Police of Peru and served as Sub-Director of Passports of the National Migration Office of Peru.

In its ruling, the Inter-American Court analyzes the violation of the presumption of innocence and the court’s obligation to provide a reasoned judgment in light of due process standards. Additionally it refers to the scope of the right to appeal the decision before a higher judge or tribunal.
