The facts of the case refer to the extrajudicial execution of a group of 5 young people living on the streets, 3 of them being minors. 4 of the victims were previously abducted and tortured. The IA Court located the events within the context of the state’s practice to use state security forces to threaten, arrest, perpetrate cruel, inhumane and degrading treatment and murder against “street children” as a means of counteracting juvenile delinquency.
The IA Court applied standards of protection for the right to life, inclusive of the guarantee to a dignified life, emphasizing the risks which “street children” are exposed to. Furthermore, it applied criteria of a complete analysis of the internal process in order to resolve the State’s failure to comply with their obligation to investigate the facts adequately and effectively.
