Case- Summary
The facts of this case relate to the massacre of a group of 15 judicial officials who were members of a Judicial Commission (Unidad Móvil de Investigación) who were performing their duties by carrying out an investigation into the massacre of 19 traders and other occurrences of violence in the region of Magdalena Medio. Of the 15 victims, 12 were executed and 3 survived.
The IA Court established State responsibility for the actions committed by paramilitary groups in the context of expansion and territorial control against guerrilla insurgents and noted the particular severity of the events that resulted in the intimidation of the judicial officials dedicated to investigating serious human rights’ violations.
The IA Court developed standards relating to the violation of the right to life of the 3 survivors, since they survived purely due to fortuitous circumstances, even though they had been dealt “the final blow”. Furthermore it analyzed the lack of investigation and impunity of the acts in relation to the standard of due diligence.
