The facts of the case relate to the forced disappearance and torture of the leaders of the political party Patria Libre Juan Arrom and Anuncio Martí, which took place in January 2002, and the impunity of the facts as a result of deficiencies in the investigation carried out by the Public Prosecutor.

The IA Court considered that the evidence offered to prove State participation in the acts denounced are insufficient to determine Paraguay’s international responsibility. Additionally, it was of the opinion that the investigation presented no manifest omissions that could have resulted in violations to the American Convention.
