The facts of the case relate to the lack of investigation and integral reparation for the diverse acts of torture suffered by Leopoldo Garcia Lucero during his detention from September 1993 until June 1975, date in which when he was exiled from Chilean territory. The described events were carried out in the context of generalised repression against those who opposed the military regime which governed Chile between 1973 and 1990.
The IA Court established the responsibility of the State for not initiating immediate and official investigations into the acts of torture committed against the victim. The Court also advanced its standards regarding the right of the victims of human rights abuses to receive integral reparations on the part of the respective State, and advised that all programmes or public policies for this purpose must be consistent with State obligations on the matter.
