The facts of the case refer to the massacre of 251 inhabitants, women, men and children, from the community of “Las Dos Erres,” which occurred on 6th to 8th December 1982 and was perpetrated by members of the specialized group within the armed force called “Kaibiles”. Judicial investigations were initiated more than 10 years after the events.

The IA Court evaluated the legal proceedings in light of the standards of due diligence, referring specifically to the pattern of sexual violence used against women in contexts of armed conflict. Furthermore, it focused on the State’s obligation to provide children with special protection, regarding the systematic pattern of illegal abduction and detention of minors perpetrated and tolerated by agents of the State at the time of the events.
