establish clear standards that provide guidance to the States Parties when defining the
delicate limits of this criminal liability in the rare situations in which a clash of precisely
substantiated rights may justify a stronger State response. However, for the purposes of this
case, the rulings of the judgment and the concurring opinions will not only provide an
adequate solution, but will provide a valuable basis for institutional dialogue with the State
Party to improve its practices pursuant to the Convention, to which it sovereignly acceded, in
a clear international commitment to the preservation of human rights.
