To declare this petition admissible with respect to Articles 4, 5, 8 and 25 of the American Convention in conjunction with Article 1(1) of the same convention and Article I of the Convention on Forced Disappearance. Furthermore, to declare this petition admissible with respect to Articles 6, 7, 11(1), 12, 13, 16, 17, 21, 22 and 24 of the American Convention in conjuction with Article 1(1) of the same Convention. In addition, by application of the principle of iura novit curia, the Commission concludes that the petition is admissible for the possible violation of Articles 3 and 23 of the Convention in relation to its Article 1(1). 2. To declare this petition inadmissible insofar as it refers to alleged violations of Article 15 of the American Convention; and of the above-referenced articles of the American Declaration, the Convention on Forced Disappearance, and the Convention on Torture. 3. To forward this report to the petitioners and the Guatemalan State. 4. To proceed to its analysis of the merits of the case. 5. To publish this report and include it in the Annual Report of the Commission to the General Assembly of the OAS.
