PARTIALLY DISSENTING OPINION OF JUDGE EDUARDO VIO GROSSI, INTERAMERICAN COURT OF HUMAN RIGHTS, CASE OF AMRHEIN ET AL. V. COSTA RICA, JUDGMENT OF APRIL 25, 2018 (Preliminary objections, Merits Reparations and Costs) Introduction In accordance with the provisions of the corresponding applicable norm, 1 in this separate opinion on the judgment in the epigraph, 2 which consists of 25 operative paragraphs, I will comment only on the five paragraphs on which I do not agree with the decision reached in the present case. Obviously, before addressing these disagreements, it is necessary to reiterate, as a preliminary matter, that I issue this opinion in the understanding that it cannot affect, in any way, the full and absolute compliance with the decision of the Inter-American Court of Human Rights 3 nor the due consideration that, in all fairness, its members deserve. Therefore, this opinion should be seen as a contribution to the understanding of the judgment and as an expression of the pluralism that prevails in the Court. Art. 65(2) of the American Convention on Human Rights: “If the judgment does not represent in whole or in part the unanimous opinion of the judges, any judge shall be entitled to have his dissenting or separate opinion attached to the judgment.” Art. 24. Statute of the Inter-American Court of Human Rights: “The decisions, judgments and opinions of the Court shall be delivered in public session, and the parties shall be given written notification thereof.
