committed “physical abuse at Metropolitan Police Station 11.” 66 These proceedings were
dismissed on December 12, 2000, by means of Decision 230. 67
43. Secondly, on July 10, 2000, while Mr. López was being held in custody, three
prosecutors visited the Specialized Group with the forensic doctor on duty to verify the
health of the detainees. 68 Mr. López told the prosecutors that he had been subjected to
torture during his time at Metropolitan Police Station 11. 69 As a result, the next day the
prosecutors present at the medical assessment sent an official letter to criminal
prosecutor J.R.A. asking him to designate a prosecutor in the case, considering that Mr.
López’s complaint “warrant[ed] investigation by the Prosecutor’s Office.” 70
44. On July 13, 2000, Mr. López repeated his complaint before the Public Prosecution
Service, affirming that he and Mr. A.C. had been tortured by National Police officers. 71
45. On July 19, 2000, criminal prosecutor A.A.B. was designated to act on behalf of
the Public Prosecution Service in Case No. 2606/2000 “Unnamed Persons, for Infliction
of Bodily Injury in the Performance of Public Duties.” 72
46. On July 28, 2000, the prosecutor filed charges for “infliction of bodily injury in the
performance of his duties” against Inspector (Comisario) J.B.P., Deputy Inspector
(Subcomisario) M.P. and officer 2nd class (Oficial 2do) O.V. 73 On July 31, 2000, the
judge of the Criminal Court of Guarantees having jurisdiction officially acknowledged
that the charges had been filed, ordered the accused to attend a hearing on August 8,
2000, and instructed the prosecutor to present her indictment on December 11, 2000. 74
47. On February 8, 2001, the Public Prosecution Service indicted Mr. W.B. for the
offenses established in Articles 307, 308 and 309 of the Criminal Code (infliction of bodily
injury in the performance of his duties and torture). 75 Since W.B. was serving as Minister
of the Interior at the time of the events, the Prosecution Service requested a waiver of
immunity from the Chamber of Deputies. 76 As the victim, Mr. López Sosa gave a
