I INTRODUCTION OF THE CASE 1. On June 22, 2004, the Inter-American Commission on Human Rights (hereinafter “the Commission” or “the Inter-American Commission”) filed before the Court an application against the State of Peru (hereinafter “the State” or “Peru”) * Judge Diego García-Sayán, a Peruvian national, excused himself from hearing this case, pursuant to Articles 19(2) of the Statute of the Court and 19 of the Rules of Procedure.
