Case- Summary
The facts of the case refer to the breach of due process of law and the right to judicial protection of Mr Raxcacó Reyes on the grounds of the death penalty sentence imposed on him for the commission of the crime of abduction, punishment that was not provided for in the law when Guatemala ratified the American Convention.
The IA Court analyzed the imposition of the death penalty in the framework established by the American Convention in Article 4. Furthermore, it developed the State’s obligation to adapt domestic law regarding the absence of legislation, which renders effective the right to pardon. Similarly, the IA Court reaffirmed standards regarding detention conditions and the so-called “death row.”
