The facts of the petition refer to the refusal of the State - through a decision of the Foreign Investment Committee – to provide Marcel Claude Reyes, Sebastián Cox Urrejola and Arturo Longton Guerrero information concerning the forestry company Trillium and the deforestation project Rio Condor, which could be harmful to the environment and sustainable development.

The Inter-American Court developed standards on the relationship between the right to freedom of thought and expression, and the right of every person to request access to information under state control. It also analyzed the state duty to substantiate administrative decisions under the guarantees of Article 8.1 of the American Convention on Human Rights.
