disappeared persons, regarding whom the State did not rebut the presumptions
nor did it make specific reference to them.341
237. In regard to the siblings and other next of kin indicated by the Commission
in its Article 50 report and in the application brief,342 the Court notes that,
pursuant to its jurisprudence, they are not considered direct family members and
thereby harm to their integrity cannot be presumed in the terms of Article 5(1) of
the American Convention. As a consequence, the Court must assess the evidence
provided.343
238. Based on the testimonial declarations, as well as the expert report and
other documents in the case file, the Tribunal finds that it has been demonstrated
that of the non direct family members, one or several of the following
circumstances have taken place: a) among them and the disappeared victims
there was a close connection, and in some cases, together with their parents and
other siblings, they formed a single nuclear family;344 b) they have involved
themselves in several actions such as the search for justice or information
