Since Peru has recognized its responsibility, the Court considers that it is in
order to proceed to the reparations stage.4 The Court considers that it is appropriate
that reparations are determined by mutual agreement between the defendant State,
the Inter-American Commission and the victims, their next of kin or duly accredited
representatives. To this end, it establishes a period of three months from the date
that this judgment is notified. The Court also considers it pertinent to indicate that it
will evaluate the agreement reached by the parties and this must be entirely
compatible with the relevant provisions of the American Convention. Should no
agreement be reached, the Court will determine the scope and amount of the
reparations.
